Gym or Personal Training Negligence
JEWELL RADIMISIS JORGE LLP Personal Injury Lawyers
Gym or personal training cases can result when people sustain injuries at a gym. If you recently got hurt while exercising at a gym, you may be entitled to compensation. It is important to speak with a personal injury lawyer about your case promptly. There is video and documentary evidence that needs to be preserved right away.
Common Types of Gym Negligence
When people walk into a gym, they expect to get in a good workout and leave. They probably do not expect to get hurt. Unfortunately, however, accidents can even happen in gyms and are often due to negligence. Here are the most common types of gym negligence.
- Poorly maintained or faulty exercise equipment. Gyms are filled with various exercise equipment, including treadmills, stationary bikes and weight racks, that can help get you into great shape. However, if the equipment is broken or defective in some way, it can cause serious injuries. Gyms are responsible for regularly maintaining their equipment and ordering the necessary repairs. If they fail to do this and someone gets hurt, they may be held liable.
- Slip and fall accidents. People can suffer slip and fall accidents anywhere, including gyms. Common causes of slip and fall accidents in gyms include liquid spills, wet floors, exposed electrical cord and gym equipment on the ground.
- Unqualified personal trainers. When you are new to the gym and do not know where to start, it can be helpful to work with a personal trainer. However, not all personal trainers may be as qualified as they should be. If you got injured while working out with a personal trainer, you may have a gym negligence case.
- Lack of supervision. If you were injured exercising when someone at the gym should have been supervising you, we may be able to help you.
- Improperly placed equipment. Gym equipment, especially items like treadmills should be spaced properly and away from obstructions. For example, a treadmill is a piece of equipment where you can simply fly off. The treadmill should be far away from a wall or column/pillar/other equipment in order to avoid striking another object and sustaining more serious injuries.
- Improper storage of equipment. Hazardous objects that are not stored properly could fall on a gym patron or interfere with the safe operation of other gym equipment, causing personal injury.
What to Do If You Were Injured at a Gym
If you sustain injuries at a gym, you should first notify the gym owner or manager. They may have to file an accident report. Then, if you are physically able, try to gather as much evidence as possible of the accident scene. For instance, if you were injured from broken exercise equipment, take photos of the equipment.
Next, seek emergency medical care, even if you don’t feel too badly hurt. Sometimes injuries can worsen over time, and you don’t want to put your health in jeopardy. A doctor should look over your injuries and then recommend the proper treatment.
It is also wise to discuss your case with a personal injury lawyer. If your injuries were due to the gym or personal trainer’s negligence, you may be able to receive compensation for your pain and suffering, medical bills, lost wages, and other losses. A lawyer can help you pursue a claim against the at fault parties and improve your chances of getting a fair settlement.
Even if there is a waiver in your gym or personal training contract, the gym or personal trainer cannot contract out of their own negligence. An experienced personal injury lawyer can help in such cases prove that the waiver does not apply.
