A school board may be liable for injuries sustained by students if they fail in providing proper supervision and protection – breaching their duty of care.
A school board’s duty of care includes:
- Supervision: they are responsible for providing adequate supervision for students.
- Maintenance: they are responsible for maintaining the premises to ensure the premises is safe for use by the students.
- Prevention: they are responsible for taking preventative measures to ensure the safety of students.
To establish liability from the school board, the following needs to be established:
- A duty of care is owed to the student
- The school board breached their duty of care
- The student suffered – damage/loss
- The breach of duty of care caused the student’s injury –damage/loss
The school board may also be vicariously liable for the negligence of its employees and volunteers including teachers and principals.
