LTD claims and Surveillance

If you are a Long-term Disability claim recipient there are a few tactics used to deny your claim.

  1. Surveillance

Once a claim is submitted, a representative will almost always conduct some form of an interview or request a written Statutory Declaration. The purpose of this is to secure your evidence regarding your restrictions and the impact on your life. More often than not you are answering truthfully and honestly.

A few months later you may be asked for an updated account of your medical status. Chances are there will be some inconsistencies or small discrepancies. At this point a private investigator may be sought to conduct surveillance. They are permitted to do so and its quite common.

Normally you may rarely leave your home but that week you decide to step outside on a daily basis. You haven’t done anything wrong, but the LTD carrier will take this as overreporting your symptoms and restrictions thus denying you benefits.

  1. Social Media

Often social media is not a reflection of our daily lives. We tend to post the most positive of activities and days. We rarely post when we are not feeling like ourselves and are in pain. Thus, when you advise the LTD representative that you are feeling down, anxious and the impact had on your familial and social relationship and yet your social media account shows a person who is active, appears happy and having dinner with friends, the opposite is perceived.
